Trademark Registration
Requirements:
- Information of applicant: Name, address, and nationality.
- Country of resident/ principal place of business
- Simply signed power of attorney
- If priority claimed, a copy of priority
- Classes and specification of goods/services, and A copy of the mark.
Time for trademark registration: 14~18 months
Patent Registration
Requirements:
- Name & Company Number/ Passport Number/ID Number of Applicant;
- Address of Applicant in English;
- Nationality of Applicant
- Passport or ID Number of Inventor;
- Address of Inventor in English;
- Nationality of Inventor;
- (If company applicant) Name & Position of a Representative to sign the application forms;
- Justification of applicant’s rights to a patent e.g. employer-employee OR execution of work commissioned by Applicant;
- Patent Specification in English;
- Certificate of Accuracy for Translation
- RO101 Request Form in FULL English-translation and Original versions (applicable for PCT National Phase Entry into Malaysia);
- ISR Report in FULL English-translation and Original versions (applicable for PCT National Phase Entry into Malaysia).
- Appointment of agent Form 17 (Equivalent to Power of Attorney);
- Priority documents, if applicable;
- Justification of applicant’s rights to a patent, e.g.:
- i. If inventor is the applicant, no supporting documents are required.
- ii. If the applicant is the employer of the inventor, OR if the applicant is the party commissioning the R&D works that lead to the invention, we need a statement to this effect. The Statement need not be notarized. Under Malaysia Patent Act, the rights to an invention accrue to the employer or the person commissioning the works that lead to the invention, unless otherwise stated in the employment contract or contract of service/ works.
- ii. If the applicant is the employer of the inventor, OR if the applicant is the party commissioning the R&D works that lead to the invention, we need a statement to this effect. Time for Patent Registration: 3~5 Years
