Trademark Registration

Requirements:

  • Information of applicant: name, address, and nationality
  • Notarized power of attorney up to the Sudanese Consulate
  • A certified and legalized copy of the Commercial Registration Certificate of the applicant
  • Classes and specification of goods/services
  • A copy of the trademark
  • A certified copy of the priority document (if claimed)
Time for Trademark Registration: 18~24 months

Note:

  • Multiple Class Registration is not available
  • Extra Fees for Color/Design Mark
  • Home/Foreign Registration is required
  • No extra Fees for Long Goods/Services

Patent Registration

Requirements:

  • Information of applicant and inventor: name, address, and nationality
  • A signed and legalized power of attorney up to the Sudanese Consulate
  • A certified and legalized copy of the certificate of incorporation of the applicant company and its articles of incorporation up to the Sudanese Consulate. A certified and legalized translation is required if the document is not in either the English language or the Arabic language
  • A copy of the patent specification and claims. An Arabic translation of the abstract of the invention only is required
  • Copy of the formal drawings
  • Copy of the priority document if priority is to be claimed.

For filing the national phase of a PCT application, the following are required:

  • PCT filing number and date
  • Particulars of the application on the basis of which priority is claimed
  • International publication number and date
  • A certified copy of the PCT application
  • A copy of the relative international publication and search report
  • A copy of PCT Preliminary Examination Report

Saudi Arabia: Subject to presenting a valid excuse, the Saudi patent office (SPO) has approved an extension of time for claiming priority in entering the national phase for the PCT applications. The Applications will be afforded the opportunity to file their late applications claiming their earliest priority. It's worth mentioning that the applicant must mention the reasons that made him unable to file his application within the thirty (30) month deadline.
