Requirements:

  • The applicant's particulars: name, address and nationality
  • Notarized and legalized power of attorney up to the Kuwaiti Consulate.
  • A certified copy of priority application (if claimed)
  • Certified copy of the home/foreign registration up to the Kuwaiti Consulate.
  • Classes and specification of goods/services
  • A copy of the trademark
Time for a trademark registration: 6~10 Months

  • No Extra Fees for Color/Design Mark

Patent Registration

Requirements:

  • The applicant's particulars: name, address and nationality
  • The inventor's particulars: name, address and nationality
  • Notarized and legalized power of attorney up to the Kuwaiti Consulate in the domicile of the applicant.
  • Notarized and legalized deed of assignment up to the Kuwaiti Consulate in the domicile of the applicant (if applicant is not the inventor)
  • A certified copy of priority application (if claimed)
  • Commercial Registration Certificate, legalized from the Kuwaiti Consulate in the domicile of the applicant.
  • Specifications, Claims, Abstract and drawings along with Arabic translations.
  • In Kuwait, the process of examination and publication of Patents has not yet began. The patent applications remains in the application stage, although this application serves as protection to such patent for twenty (20) years from the date of filing and serves the purpose of a priority claim as well. Annuity fees and such other services are also not operational so far.

Industrial Design Registration

Requirements:

  • The applicant's particulars: name, address and nationality
  • The designer's particulars: name, address and nationality
  • Notarized and legalized POA up to the Kuwaiti Consulate in the domicile of the applicant.
  • Extract from the Commercial Registration Certificate or a copy of the Articles of Association, legalized up to the Kuwaiti Consulate, if the applicant is a company.
  • Certified Priority Document, if claimed.
  • Each view of proposed design with description of the proposed design application.

Saudi Arabia: Subject to presenting a valid excuse, the Saudi patent office (SPO) has approved an extension of time for claiming priority in entering the national phase for the PCT applications. The Applications will be afforded the opportunity to file their late applications claiming their earliest priority. It's worth mentioning that the applicant must mention the reasons that made him unable to file his application within the thirty (30) month deadline.
